These Terms and Conditions (“Terms,” “Agreement”) govern your access to and use of our website, services, materials, and any interactions you have with Goodwill Trucking (“Company,” “we,” “our,” “us”). By visiting our website, requesting a quote, placing an order, or using any of our services, you acknowledge that you have read, understood, and agreed to be bound by these Terms.

- DEFINITIONS
For clarity throughout this Agreement, the following terms have the meanings stated below:
- “Company” refers to Goodwill Trucking, located in Powder Springs, GA.
- “Services” refers to all hauling, selling, and delivery services, including the delivery of dirt, topsoil, sand, crusher run, 57 stones, 34 stones, rip rap, and other construction materials.
- “Customer,” “Client,” “You,” refers to any individual, contractor, homeowner, entity, or organization purchasing or using our services.
- “Materials” refers to all construction and landscaping materials delivered by the Company.
- “Website” refers to the Company’s official website and any associated digital properties.
- “Order” refers to any request for materials or services submitted by the Customer.
- “Delivery Site” refers to the location specified by the Customer for material delivery.
- ACCEPTANCE OF TERMS
By using our services or placing an order, you confirm that:
- You are at least 18 years old.
- You are legally able to enter into binding agreements.
- You will provide accurate information when placing an order.
- You understand that the Company may update these Terms at any time, and continued use constitutes acceptance of any changes.
- SCOPE OF SERVICES
Goodwill Trucking offers hauling, selling, and delivery of construction and landscaping materials. Our services include but are not limited to:
- Delivery of dirt, topsoil, sand
- Delivery of crusher run, 57 stones, 34 stones, rip rap
- Hauling services for construction sites
- Same-day delivery when available
- Material unloading at the Customer’s designated site
- Support for contractors and homeowners
The Company reserves the right to modify, limit, or discontinue any service at any time without prior notice.
- ORDERING AND PAYMENT
4.1 Placing an Order
Orders may be placed via phone, website form, or direct communication. When placing an order, you must provide:
- Your full name or business name
- Delivery address
- Contact phone number
- Type and amount of materials
- Delivery date and time preference
- Special instructions (if applicable)
All orders are subject to availability.
4.2 Pricing
Prices are determined based on:
- Material type
- Material quantity
- Delivery distance
- Fuel costs
- Labor and operational expenses
Prices may change without prior notice. Any quote provided is valid only for the date stated unless otherwise agreed.
4.3 Payment Terms
Payment must be made according to the method agreed upon during ordering. The Company accepts:

- Bank transfer (where applicable)
Payment is due at or before delivery, unless a prior written arrangement has been approved.
4.4 Late Payments
Any late or delayed payment may result in:

Customers are responsible for all collection costs, attorney fees, and administrative charges associated with late payment recovery.
- DELIVERY TERMS
5.1 Delivery Area
Goodwill Trucking provides delivery services primarily within Powder Springs, GA, and surrounding regions. Delivery outside of this area may be approved at the Company’s discretion and may incur additional fees.
5.2 Delivery Schedule
We strive to offer same-day delivery, depending on availability, weather conditions, equipment readiness, and order volume. We do not guarantee specific delivery times.
5.3 Delivery Site Requirements
Customers must ensure the delivery site meets the following conditions:
- Safe and accessible for heavy trucks
- Free of obstacles, debris, overhead wires, and hazards
- Adequate space to unload materials safely
- Proper groundwork to support truck weight
If the delivery site is deemed unsafe or inaccessible, we may:
- Deliver at the nearest accessible point
- Reschedule the delivery
- Cancel the order
Customers will be responsible for any additional costs.
5.4 Unloading Responsibility
Once our truck reaches the delivery site:
- Our driver will unload materials in the most suitable and safe location.
- Drivers may decline unloading if unsafe conditions exist.
- The Customer is responsible for directing the drop location and assumes all responsibility for any resulting damage.
5.5 Delivery Delays
The Company is not liable for delays caused by:
- Traffic
- Weather conditions
- Vehicle breakdowns
- Road closures
- Customer unavailability
- Incorrect delivery information
- MATERIAL QUALITY AND AVAILABILITY
We strive to supply high-quality materials; however:
- Natural materials may vary in color, texture, size, and composition.
- Material availability may fluctuate due to supplier conditions.
- Customers acknowledge that natural variations are not grounds for refunds.
If a certain material is unavailable, we will notify the Customer and offer:
- A substitute material
- Rescheduled delivery
- Full cancellation with no penalty
- CUSTOMER RESPONSIBILITIES
The Customer agrees to:
- Provide accurate delivery instructions and contact information.
- Ensure the delivery site is safe and accessible.
- Obtain any necessary permits or approvals for unloading.
- Be present during delivery or appoint an authorized representative.
- Inspect delivered materials immediately upon unloading.
- Pay all costs associated with materials, delivery, and additional services requested.
Failure to meet these obligations may result in additional charges or service refusal.
- CANCELLATIONS, CHANGES, AND REFUNDS
8.1 Cancellations by Customer
Cancellations must be made at least 24 hours before the scheduled delivery.
Late cancellations may result in a fee to cover operational costs.
8.2 Changes to Orders
Any change in:
- Quantity
- Materials
- Delivery time
- Delivery location
must be communicated as early as possible, and may affect pricing or availability.
8.3 Cancellations by the Company
We reserve the right to cancel any order due to:
- Unsafe or inaccessible delivery sites
- Inaccurate information
- Non-payment
- Environmental conditions
- Equipment issues
If we cancel, the Customer will receive a full refund unless cancellation is due to the Customer’s fault.
8.4 Refund Policy
Due to the nature of heavy construction materials, all materials delivered are non-returnable and non-refundable once dropped.
Refunds apply only when:
- The wrong material was delivered
- A service was paid for but not completed
- The Company approves the refund upon investigation
- LIMITATION OF LIABILITY
Goodwill Trucking is not liable for:
- Damage to lawns, driveways, sidewalks, pavement, pipes, curbs, or landscaping due to truck weight
- Property damage caused by Customer-directed unloading
- Material variations in size, color, or texture
- Project delays caused by late delivery, weather, or site inaccessibility
- Losses arising from misuse of materials
- Indirect, incidental, or consequential damages
Customers assume full responsibility for any damage resulting from:
- Inadequate ground conditions
- Incorrect delivery instructions
- Unsafe delivery environments
Our liability is limited strictly to the amount paid for the order in question.
- EQUIPMENT ACCESS AND SITE DAMAGE DISCLAIMER
Customers acknowledge that:
- Our trucks are heavy and may leave tire marks or cause soil disturbance.
- Driving over grass, dirt, or soft ground is at the Customer’s risk.
- The Company is not responsible for underground damage, including:
- Irrigation lines
- Septic systems
- Water pipes
- Electrical conduits
- Gas lines
Customers should clearly mark or communicate any sensitive areas.
- COMMUNICATIONS
By contacting us or placing an order, you consent to receiving communications through:
- Phone calls
- Text messages
- Emails
- Website forms
These communications may include order confirmations, delivery updates, or service details.
- INTELLECTUAL PROPERTY
All content on our website—including text, logos, images, icons, graphics, and layout—is owned by Goodwill Trucking and protected by intellectual property laws.
You may not:
- Reproduce
- Modify
- Distribute
- Use for commercial purposes
any content without the Company’s written permission.
- PRIVACY
We respect your privacy. Any personal information you provide will be handled according to our Privacy Policy, which outlines:

By using our services, you agree to our Privacy Policy.
- INDEMNIFICATION
You agree to indemnify and hold harmless Goodwill Trucking, its employees, and affiliates from any claims, losses, damages, or expenses arising from:

- Delivery site hazards
- Property damages caused by site conditions
- Customer-provided incorrect instructions
- Violations of this Agreement
- SERVICE INTERRUPTIONS
We do not guarantee the uninterrupted availability of our website or services. Interruptions may occur due to:
- System maintenance
- Technical failures
- External disruptions
We are not liable for any inconvenience caused by such interruptions.
- FORCE MAJEURE
The Company is not responsible for failure or delay in delivering services due to circumstances beyond our control, including:
- Severe weather
- Natural disasters
- Accidents
- Strikes
- Equipment failures
- Supply shortages
- Road closures
- TERMINATION OF SERVICES
We may suspend or terminate services at any time if:
- The Customer violates these Terms
- Payment is not made
- Unsafe site conditions exist
- Fraudulent activity is suspected
Termination does not release the Customer from outstanding payment obligations.
- GOVERNING LAW
These Terms are governed by and interpreted according to the laws of the State of Georgia, without regard to conflict-of-law principles.
Any disputes shall be resolved in courts located in Georgia.
